Problems and Suggestions of the Classification of Medical Institution in Current Laws

Abstract
Objectives: This study is performed to investigate the classifications of medical institution in laws and suggest reasonable classification to deliver the systematic medical practice. Current laws related to classification of medical institution in Medical Services Act, National Health Insurance Act, Emergency Medical Services Act and other laws were extensively analyzed. The current classification of medical institution mainly depends on the Medical Services Act; clinic, hospital and general hospital. But the definition of medical institutions are very various according to the laws. These classification system results in several problems as followings;

Methods and Results: First, it is not reasonable because current criteria of classification are based on the number of beds, not its roles and functions. Moreover, this classification is not consistent with the category of other laws; there is contradictory regulation for same institution. Secondly, the classifications of health service in laws are inconsistent and unsystematic because they are established separately and standard Medical Services Act and its ordinances don¡¯t have a
systematic categorization. Lastly, incentive in medical fee is correlated to the size of hospital; this lead to increase in the hospital size without quality improvement.

Conclusions: So the current classifications of medical institution should be accorded with the health care delivery and be comprehensive with a complete continuum of service ranging from primary care to tertiary care.
